Integrated care boards (ICBs) are being asked to work with local partners to identify people with a learning disability and autistic people who may be affected by changes introduced through the Mental Health Act 2025.
NHS England has developed an identification tool to support ICBs in understanding the potential impact of changes to the criteria for detention.
The Mental Health Act 2025 received Royal Assent in December 2025 and includes reforms intended to reduce the number of people with a learning disability and autistic people detained in mental health hospitals. The wider reforms are designed to give people greater choice and control over their treatment.
ICBs are being asked to use the new identification tool during August and September, working alongside local partners to build a clearer picture of the people who could be affected by the changes.
The exercise is expected to help local systems understand the potential implications of the new detention criteria and inform planning for the support and services that may be required.
Following the assessment work, ICBs have been asked to submit a national return to NHS England by 16 October 2026.
