Government takes action to crack down on rogue funeral operators

The government has announced plans to strengthen oversight of the funeral sector following a major criminal case in Hull that exposed serious concerns about the treatment of deceased people.

The Department of Health and Social Care will lead cross-government work to develop proposals aimed at raising standards and protecting bereaved families, including consideration of formal regulation of the funeral sector. The action follows the sentencing of Robert Bush, of Legacy Independent Funeral Directors in Hull, to 20 years in prison for 67 charges, including preventing a lawful and decent burial, fraud, fraudulent trading and theft.

The government said it will work with the Ministry of Justice, Law Commission, funeral providers, faith groups, bereaved families and other stakeholders as it develops the proposals.

The Law Commission will also review criminal law relating to deceased people to identify potential gaps in existing protections and consider whether new criminal offences are required.

Health and Social Care Secretary Yvette Cooper said the government would bring forward comprehensive proposals designed to ensure people are treated with dignity after death and to drive rogue operators out of the industry.

Industry bodies have welcomed the move, with the National Association of Funeral Directors saying it believes statutory regulation could provide greater protection for bereaved families. The government said any future measures will be developed with the aim of creating clear and consistent standards while ensuring the approach is proportionate and informed by those working within the sector.
