Existing care workers could be exempt from tougher UK immigration rules

The UK Government is considering exempting existing overseas care workers from planned changes that would make it harder to qualify for indefinite leave to remain (ILR), as ministers seek to address ongoing workforce pressures in adult social care.

The proposal, which is under consideration and has not yet been confirmed, would exempt many care workers already living and working in the UK from planned reforms that would extend the qualifying period for settlement. The exemption is expected to be considered following the Home Office’s consultation on the proposed immigration changes.

The reported plans come as the Government prepares to accelerate wider reforms to adult social care, including bringing forward the final report of the independent review being led by Louise Casey and continuing work towards establishing a National Care Service.

The adult social care sector has warned that extending the route to settlement for overseas workers could worsen recruitment and retention challenges. Trade union Unison said care providers need greater support to recruit and retain staff, while providers have highlighted continued financial pressures and workforce shortages.

The Home Office has previously confirmed that new overseas recruitment of care workers ended in 2025. However, care workers already in the UK can continue to extend their visas and change sponsors under transitional arrangements.
